Welcome to Get Your Fixx™ Coffee & Tea. These Master Terms of Service (“Terms”) govern your access to and use of the website located at https://getyourfixx.com/ (the “Site”), our subscription services, and the purchase of our premium coffee, artisan teas, and institutional offerings (collectively, the “Services”).
0. ACCEPTANCE OF TERMS
By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree, do not use the Services.
You also agree to comply with all applicable laws, rules, and regulations when using the Services, including laws governing marketing communications, endorsements, and labeling.
1. THE LUXURY STANDARD & ELIGIBILITY
Get Your Fixx™ Coffee & Tea provides specialty-grade products curated for high-performance individuals and elite corporate environments. Our Services are intended for users who are at least 18 years of age. By using the Site, you represent that you meet this requirement and that your use of the Services does not violate any applicable law or regulation.
1.1 LUXURY STANDARDS & ARTISAN CLAIMS
We represent that our specialty teas— including Hand-picked Jasmine and Stone-milled Matcha—are marketed and described as meeting rigorous artisan standards tied to manual production and/or traditional processing methods. “Artisan,” “hand-picked,” “stone-milled,” “small-batch,” and similar terms are used to describe production attributes (e.g., manual harvesting, traditional milling, or craft processing), not medical outcomes.
If supply chain conditions require us to substitute a lot, producer, or processing method, we may update product descriptions to remain accurate. Product images and descriptors are illustrative and may vary by harvest/lot without affecting functionality or intended use.
2. ACCOUNTS AND SECURITY
To access certain features, including corporate procurement and subscription management, you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials. Get Your Fixx™ reserves the right to terminate accounts that demonstrate fraudulent activity or fail to uphold the brand’s community standards.
3. PURVEYANCE, PRICING, AND SUBSCRIPTIONS
3.1 Product Availability: We source only the highest-tier beans and teas. Due to the seasonal and artisanal nature of our inventory, availability is subject to change without notice.
3.2 Luxury Pricing: Prices for our products are subject to change. We do not offer price matching against mass-market retailers.
3.3 Subscription Services: By enrolling in a Get Your Fixx™ subscription, you authorize recurring charges to your payment method at the frequency selected. You may modify or cancel your subscription through your account portal at least 48 hours prior to the next billing cycle.
4. CORPORATE AND INSTITUTIONAL PROVISIONS (B2B)
For entities utilizing our corporate form or B2B infrastructure:
- Onboarding: Corporate partners are subject to an initial "Infrastructure Audit" to ensure product integration meets our quality standards.
- Resale: Unless explicitly authorized via a separate Wholesale Agreement, products purchased on this Site are for internal consumption or hospitality use only and may not be resold in a retail capacity.
- Luxury Product Offerings (Illustrative): Our luxury offerings may include curated coffee and tea programs, corporate provisioning, VIP hospitality integrations, subscription services, and product bundles/boxes such as the White Glove Experience Box (where available).
- B2B SMS Compliance: By submitting a corporate inquiry, you consent to receive administrative and account-related SMS communications pursuant to the TCPA updates of 2026 and Texas SB 140.
4.2 B2B EARNINGS AND MARGIN DISCLAIMER
Any revenue, earnings, margin, or profitability statements (including any referenced 17%–25% margin range associated with the White Glove Experience Box) are estimates only based on standard retail pricing assumptions and estimated cost of goods sold (COGS). These figures are provided for informational purposes and are not a promise or guarantee of profit, margin, sales results, or business performance.
Actual results vary and depend on the partner’s individual business execution, location, local market conditions, pricing strategy, operating expenses, staffing, merchandising, and sales volume. You are solely responsible for evaluating the economics of your business and for all decisions related to pricing, promotion, resale (if authorized), and operations.
4.1 B2B & CORPORATE SERVICES (WORKPLACE INFRASTRUCTURE / INSTITUTIONAL ACCOUNTS)
The following terms apply to corporate, workplace, hospitality, and institutional accounts (collectively, “Institutional Accounts”):
- Authorized Representative: You represent and warrant that the person submitting an inquiry, creating an account, placing an order, or otherwise engaging us on behalf of an entity is an authorized representative with authority to bind the entity.
- Use Case / Internal Program: Products and Services for Institutional Accounts are intended for internal workplace consumption, employee perk programs, client hospitality, or similar institutional use, unless a separate written agreement (e.g., Wholesale Agreement) expressly authorizes resale.
- Procurement & Administrative Contacts: You agree to provide accurate procurement and administrative contact information and to keep it current for billing, delivery scheduling, program updates, and service communications.
- Program Standards: Where an Institutional Account requests product standards, brewing SOPs, or workplace beverage “infrastructure” recommendations, any guidance we provide is operational and educational (not medical or safety compliance advice), and you are responsible for your own workplace policies, compliance, and implementation.
- Additional Terms May Apply: Certain Institutional Accounts may be required to execute additional written terms (e.g., a wholesale agreement, subscription addendum, or SMS compliance agreement) which will control in the event of conflict with these Terms.
5. SMS/MMS MOBILE MESSAGING MARKETING PROGRAM
By opting into our marketing communications, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., cart reminders, luxury drops).
- Consent: Consent is not a condition of any purchase.
- Opt-Out: Reply STOP to cancel at any time.
- Data: Message and data rates may apply.
5.1 SMS/TCPA COMPLIANCE (FORM-BASED CONSENT; CORPORATE + RETAIL)
Where our Corporate or Retail forms include an SMS consent checkbox and/or SMS consent language, by submitting that form you provide your express written consent to receive marketing text messages (including by automated technology) at the phone number you provide, consistent with the Telephone Consumer Protection Act (“TCPA”), applicable 2026 TCPA updates, and Texas SB 140, as applicable.
- Scope: Consent may include marketing, promotional offers, product releases, and service updates. Transactional/administrative messages (e.g., order and account messages) may be sent separately where permitted by law.
- No Purchase Required: Your consent is not required as a condition of purchase.
- Recordkeeping: We may maintain records of your consent (e.g., timestamp, form, IP address, and the language presented at time of opt-in) to demonstrate compliance.
- Opt-Out & Help: Reply STOP to opt out; reply HELP for help. Opt-out requests may take a reasonable period to process.
- Eligibility: You must be the subscriber or customary user of the number you provide and have authority to consent.
6. INTELLECTUAL PROPERTY
The "Get Your Fixx™" name, logos, "Built for the Grind" slogan, and all site content are the exclusive property of Get Your Fixx™ Coffee & Tea. Unauthorized use of our trademarks or copyrighted material for commercial purposes is strictly prohibited and will be met with immediate legal action to protect our brand equity.
7. LIMITATION OF LIABILITY
Get Your Fixx™ Coffee & Tea provides "Cognitive Performance Enhancers" (as defined in our internal Legal Infrastructure Protocol). We are not responsible for any adverse reactions resulting from caffeine sensitivity or improper brewing techniques. Our liability is limited to the maximum extent permitted by law and shall not exceed the total amount paid by the customer for the product in question.
8. GOVERNING LAW
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts of [Insert County], Texas.
8.1 SHIPPING AND DELIVERY (CONTIGUOUS UNITED STATES ONLY)
We sell and ship products only to addresses within the contiguous United States (the “mainland” U.S. / lower 48 states). We do not ship internationally and we do not ship to Alaska, Hawaii, U.S. territories or possessions (including, without limitation, Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, and the Northern Mariana Islands). Orders submitted with ineligible shipping addresses may be cancelled and refunded in our discretion.
9. AFFILIATE DISCLOSURES (AMAZON + OTHER AFFILIATE LINKS)
Some content on the Site (including reviews, recommendations, and “gear” content) may contain affiliate links. When required, we will clearly disclose affiliate relationships.
Amazon Disclosure: On all review and gear content that includes Amazon affiliate links, the following disclosure must be included: “As an Amazon Associate, we earn from qualifying purchases.”
You agree not to remove, obscure, or alter required affiliate disclosures when reposting, syndicating, quoting, or otherwise using our content.
APPENDIX A: TEA COMPLIANCE & ARTISAN STANDARDS
This Appendix governs the purchase and marketing of all tea products sourced via our artisan partners.
A.1 Artisan Definitions
All products labeled as "Artisan" or "Small-batch" (including but not limited to Jasmine Green Tea and Matcha) are verified to involve manual labor or traditional processing techniques (e.g., hand-picking, stone-milling). These designations are maintained in compliance with 2026 FTC guidelines regarding manual skill in food production.
A.2 FDA "Healthy" Labeling Disclosures
In accordance with the 2026 FDA Final Rule on "Healthy" labeling:
- Qualifying Teas: Only unflavored or naturally flavored teas derived from the Camellia Sinensis plant (Green, Black, White, Oolong) containing <5 calories per 12-ounce serving may be referred to as "Healthy" or "Heart-Healthy."
- Herbal Infusions: Products such as Rooibos, Hibiscus, and other herbal "teas" are categorized as botanical infusions. While premium in quality, these products are not eligible for "Healthy" claims under current federal guidelines.
- Additives: The addition of honey, sugar, or milk by the consumer nullifies the "Healthy" designation of the base product.
A.3 No Medical Claims
While our teas are selected for their superior antioxidant profiles and traditional uses, Get Your Fixx™ Coffee & Tea makes no express or implied claims that any tea product can treat, cure, or prevent any disease. Any mention of "well-being" or "performance" refers to the subjective experience of luxury consumption and caffeine-related alertness.
A.4 Performance Disclosures (Educational Use Only)
Any references to “cognitive,” “focus,” “executive performance,” “productivity,” or similar terms are for general educational and lifestyle discussion purposes only and do not constitute medical advice, diagnosis, or treatment. If you have a medical condition, are pregnant or nursing, or are sensitive to caffeine or botanicals, consult a qualified healthcare professional before use.
A.5 Tea Compliance Appendix (March 2026) — ‘Healthy’ and Category Clarifications
- “Healthy” Claims (Camellia Sinensis Only): “Healthy” claims are only applicable to teas derived from Camellia sinensis (e.g., Black, Green, White, Oolong) that contain less than 5 calories per serving and no additives.
- Herbal Infusions (Rooibos / Hibiscus): Herbal products (including Rooibos, Hibiscus, and similar botanicals) are labeled and treated as botanical beverages/infusions, and are not marketed as “Healthy” under 2026 FDA guidelines.
A.6 Dropship Fulfillment
Certain tea products are fulfilled via our specialty manufacturing partners (e.g., Temecula Coffee Roasters). While Get Your Fixx™ maintains strict quality oversight, we rely on the botanical certifications provided by the manufacturer. All ingredient lists provided on the Site are derived directly from manufacturer laboratory data.
